Tiny TIMBERS is a manufacturer/distributor and does not provide design, engineering, material take-offs, construction or installation services. We warrant that our products, as shipped in their original manufactured state to meet or exceed accepted industry standards, as further defined:
  1. Free from defects in materials and workmanship when released from our possession.
  2. Of the grade described in our published product specifications, invoice or sales receipt and pursuant to the National Hardwood Lumber Association (NHLA) grading rules. Although grade standards apply to all American hardwoods, numerous variables, exceptions, and special grading rules apply to certain species. Please read and fully understand the grading standards and mill finish of your requested products prior to placing your order.
  3. Naturally occurring color, grain or character allowable within the stated grading standards are not considered defects.   4. Unless stated as green, unseasoned, air dried or otherwise, our grade hardwood lumber, flooring, paneling and millwork including doors and stair components shall be kiln dried and conditioned to 8% ambient moisture content; finish grade cypress shall be kiln dried between 10% and 12% moisture content. Post-sale moisture content changes are beyond our control and not warranted.
  5. Kiln Dried Hardwoods are not recommend or warranted in exterior applications and should never be exposed to the elements.
  6. Since each product we manufacture is unique, the yield for each run will vary. It is not always possible to match exact footage on every order. Therefore, your order may include up to 5% over your requested or quoted footage. On specified lengths, we reserve the right to substitute the next longest available stock length when necessary, which depending on the lengths, may exceed 5%. In both instances, you will be invoiced for the actual footage shipped.
  7. Due to the milled-to-order nature of many of our products, once your order as been confirmed and the production process started, your deposit is non-refundable. However, entirely at our option, subsequent change orders may be accepted. Change orders must be confirmed in writing by Tiny TIMBERS.
  8. Items denoted as custom are considered non-cancelable once your order has been confirmed and materials requisitioned.
We have made every attempt to provide current and accurate pricing. However, prices are subject to change and errors corrected, without notice. Due to the diverse nature of our products, grades, and species, all items are subject to availability. Our mill generally runs on a 5 to 15 business-day production schedule, although many stock items may be available for prompt shipment. We will provide availability and confirm prices prior to confirming your order.

A 20% deposit is requested on most items manufactured to order. Certain items denoted as custom or special ordered may require up to a 40% deposit. We will confirm deposit requirements at order placement. The final remaining balance is due within 15 days after notice of order completion or at the time of shipment, which ever occurs first. For your convenience, we accept American Express, Discover Card, Master Card and Visa, bank wire, certified funds, and of course, cash 🙂

Accounts not paid in full within terms will be assessed a late fee of 1.5% per month (18% APR) with a $5 per month minimum billing charge on all past due accounts, plus the cost of collections, including but not limited to reasonable attorney’s fees.

Checks returned for insufficient funds shall be assessed a $30 return check fee.

Unless stated otherwise, all products are sold FOB our mill in Deputy, IN 47230. Delivery is typically available and quoted on request. Please click here to view detailed shipping information and delivery options. Since our operations are “tiny”, space is a valuable commodity. We must insist on timely delivery/pickup of your order and & settlement of your account. You must make prior arrangements for storage of your finished product. Storage fees of $5.00 per day per bundled item will be assessed starting on the 15th day after invoice. Materials not claimed within 45 days of invoice will be considered abandoned and all materials and payments on account will be forfeited.

It is important for you to inspect your order upon receipt. If your order was shipped by a third party or common carrier, note any visible damages directly on the bill of lading (provided by the shipping carrier at the time of delivery). Concealed damages must be reported within 5-business days. You must also contact Tiny TIMBERS to initiate the claims process with the shipping carrier.

For any incomplete or incorrect shipments you must notify us within 5-business days of receipt of your order. We will expeditiously correct or refund any deficiencies determined to be our fault, including applicable shipping and handling costs to correct your order.

The installer/end-user assumes all responsibility for final inspection to determine if the material meets expectations PRIOR to altering, finishing, or installing any material.

Returns are limited to stock material only that has been purchased within the past thirty (30) days. Materials accepted for return (excepting errors that we have made or damaged shipments) must have prior authorization, be returned at buyers expense and may be subject to a 20% restocking charge. Replacement stock will be provided or in-house credit will be issued. Cash refunds are not permitted. Items noted as “custom”, “used”, “as is”, timbers, posts and beams, tooling costs, doors, jambs, stair components, materials specified to non-standard sizes, modified in any way or reflecting job site or handling neglect are not returnable.
Solid Hardwood Flooring Warranty Terms

For all other items, this limited warranty is extended only to the original buyer located in the United States and excludes products designated as used, seconds or sold “as is”. This limited warranty gives you specific legal rights. You may also have other rights, which vary from state to state.

This limited warranty excludes consequential or value added processes such as sanding, finishing, installations, assembly, or cutting materials to length or any other associated costs, including, but not limited to the removal or replacement of cabinets, fixtures, retail markups, installation or labor provided by others or supplemental costs, relocation during the repair process such as hotel, meals, or moving and storage of furniture. Sole remedy here-under is limited to product repair or replacement not to exceed the dollar value of the original purchase. No other warranty is expressed or implied.

Interpretations – this sale shall be governed solely by the terms and conditions herein set forth, which shall prevail over any conflicting terms and conditions of buyer, any statement in buyer’s purchase order, notwithstanding. The terms of this agreement may not be extended, discharged, amended or modified, in any way, except by a writing signed by an authorized representative of each party. This agreement shall be construed in accordance with the laws of the State of Indiana.

All prior writings, representations or negotiations with respect to the subject matter are deemed to be merged herein. The failure of either party to enforce any of the provisions of this agreement shall not be construed as a waiver of such provision or of the right of any party thereafter to enforce each and every provision.

TO THE EXTENT PERMITTED BY LAW, THE WARRANTY SET FORTH HEREIN IS EXCLUSIVE, AND IN LIEU OF AND EXCLUDING ALL OTHER WARRANTIES OF TINY TIMBERS, ITS AGENTS, RESELLERS, OR EMPLOYEES, WHETHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TINY TIMBERS LIABILITY TO ALL PURCHASERS OF ALL PRODUCTS IS LIMITED SOLELY AND EXCLUSIVELY TO THE OBLIGATIONS SPECIFICALLY SET FORTH HEREIN, EXCEPT TO THE EXTENT SPECIFICALLY PRECLUDED BY APPLICABLE LAW, AND DOES NOT INCLUDE ANY LIABILITY FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR OTHER DAMAGES OF ANY KIND WHATSOEVER, WHETHER ANY CLAIM IS BASED UPON THEORIES OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.

SOME STATES DO NOT ALLOW LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
